Privacy Policy for MIC Websites

The purpose of this privacy policy is to explain how Marketech International Corporation (hereinafter referred to as "MIC") collects and processes (hereinafter referred to as ”Process” or “Processing”) your Personal Data. This policy applies to individuals and individuals outside MIC, including customers, visitors to MIC's website, users of MIC's products or services, employees of MIC's customers and contractors, applicants of MIC, visitor to MIC (hereinafter referred to as "you").

(7) For the purpose of maintaining the security of MIC’s plant (including but not limited to the plant site visit records, monitor records, and system login records and access records and other electronic security measures), MIC may Process your Personal Data in order to perform its statutory duties or fulfill its statutory obligation, or base on MIC’s legal interests for the aforementioned purposes (to the extent that such legitimate interests is not overridden by your interests, fundamental rights and freedoms).

(8) For the purpose of fulfilling statutory obligations such as case investigations, MIC may Process your Personal Data for cooperating with the judicial authorities in detecting and investigating fraud and other crimes in accordance with applicable laws and regulations, and preventing violations of MIC’s regulations and criminal offences.

Except for special circumstances, in the ordinary course of MIC’s business, MIC will not Process your Sensitive Personal Data. However, it becomes necessary to Process your Sensitive Personal Data for legitimate purpose, MIC will do so it accordance with applicable law. MIC may Process your Sensitive Personal Data types including medical records, family medical history, healthcare records, physical examination records, criminal records, etc. MIC may Process your Sensitive Personal Data in the following situations:

  • To comply with applicable laws and regulations: To the extent of required or permitted by applicable laws and regulations, MIC may Process your Sensitive Personal Data (e.g., to comply with MIC's diversity reporting obligations).

(2)MIC may obtain your Personal Data through direct contact with you because of business visits or other parties.

(3) MIC may obtain your Personal Data due to business cooperation (including but not limited to cooperating with you in research and development, conducting business transactions to provide products or services, hiring you as a consultant, lecturer of MIC, or you’re the contact window for the aforementioned business cooperation, etc.).

(5) MIC may obtain your Personal Data from you by logging into the MIC system of MIC's website and using the functions or resources on MIC's website.

(6) MIC may obtain your Personal Data from the information provided by third parties (including but not limited to credit reference agencies, law enforcement agencies, etc.).

5. MIC may take the initiative to create your Personal Data file

MIC may record and use the Personal Data (such as your interaction record with MIC) obtained in the MIC system, the provision of goods and services.

6. The parties with whom MIC may share your Personal Data

(1) MIC may share your Personal Data with:
  • You and the agent appointed by you
  • The judiciary authorities. MIC may disclose your Personal Data to them in accordance with legal requirements, or to report any illegal or suspected illegal behavior.
  • Accountants, auditors, consultants, lawyers and other professionals who is under confidentiality obligation to MICProvide your Personal Data to MIC’s global service providers under this Policy (for example: payment service agencies, freight companies, etc.)

7. Data profiling and automated decision-making

MIC may Process your Personal Data and make it subject to automated decision-making and profiling for the following purposes:

In order to prevent information leakage and protect MIC's intellectual property rights, MIC may Process and use the information you share with any other MIC's employees in order to establish a threatening behavior model or analyze the possible threats to MIC’s information system, which may possibly affect the privacy of communications between you and any other MIC's employees. Therefore, if not necessary, it is recommended that you avoid exposing your Sensitive Personal Data or any other Personal Data that is highly-privacy or confidential in your communications with any other MIC’s employees.

8. Cross-border transfer of Personal Data

In consideration of the international and transnational nature of MIC's business and services, we will transfer your Personal Data to MIC's Affiliates, including but not limited to those in Taiwan, United States, Japan, South Korea, Netherlands, Singapore and other countries where the level of protection to Personal Data might be different from the country you based in, in accordance with Article 6 of this policy and any purposes within the scope of this policy.

If we transfer your Personal Data from the EU to other countries that is not certified by EU regarding the adequacy of the level of protection, we will enter into a contract based on EU’s standard terms with the recipient. You may request for reviewing the foregoing standard contract terms by contacting MIC in accordance with the contact information specified in Article 17 of this policy.

Please note that when you directly transfer your Personal Data to our affiliated companies outside the EU, we cannot be held responsible for the transfer thereof.

9. Information Security

MIC has employed appropriate technical and organizational security measures in accordance with the applicable law to prevent your Personal Data from being accidentally or intentionally damaged, lost, tampered with, unauthorized disclosure, unauthorized access, and other illegal or unauthorized Processing.

Due to the open nature of the Internet, the information transmitted over the Internet is not completely secured. Although MIC has employed all reasonable measures to protect your Personal Data, there is still no guarantee that the processing of transmitting information via the Internet will be completely safe. If there is any error exist in your Personal Data, our company will immediately correct or delete it. In order to ensure the accuracy of your Personal Data, our company may occasionally confirm the accuracy of your Personal Data with you.

11. The principle of minimizing the Processing of Personal Data

MIC endeavors to employee reasonable measures to ensure that the scope of Personal Data processed by MIC has a reasonable relevance to the purposes contained in this policy, and is limited to the Processing within the reasonable scope.

12. Personal Data retention period

MIC endeavors to take reasonable measures to ensure that the Processing of your Personal Data by MIC will only be made for the period necessary for the purposes listed in this policy. MIC will keep your Personal Data in accordance with the following principles:

(1) During the period that there is a continuous employment relationship between you and MIC (for example: from the time you approached MIC as an employee of your previous company, and until you notify MIC of your intention to leave).

13. Your rights to your Personal Data

According to applicable Personal Data protection laws or regulations, you may claim the following rights to MIC:

(1) Review your Personal Data, request MIC to provide a copy of your Personal Data, supplement or rectify your Personal Data.

(2) Refusal to provide your Personal Data: However, please note that if you refuse to provide your Personal Data, MIC may not be able to fully provide you with our products or services. For example, due to lack of necessary information, MIC may not be able to Process your request for review your Personal Data.

(3) Stop Processing your Personal Data, restrict the Processing of your Personal Data, delete your Personal Data, or transfer your Personal Data to other Personal Data controllers under reasonable and feasible technical premises.

(4) Withdrawing your consent to the Processing of your Personal Data by MIC: please note that withdrawing your consent will not affect the legality of MIC's Processing of your Personal Data based on your prior consent. If the Processing of your Personal Data has other legal basis, MIC may continue to Process your Personal Data.

(5)You reserve the right to appeal to the competent authority responsible for information protection for the Processing of your Personal Data.

(6) On the premises of complying with applicable laws and regulations, you have the right to object to the third party who Processes your Personal Data on behalf of MIC.

(7) If you intend to exercise the above rights or have any questions about this privacy policy, please contact MIC in accordance with the contact information in Article 16 of this policy. However, please note that before MIC can provide any assistance to your request, you need to provide identification documents in order to exercise the above rights.
